Terms of Service

1. Acceptance of Terms

By accessing or using the Mahadata platform, including our website, APIs, and any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services. These Terms constitute a legally binding agreement between you or the entity you represent ("Client" or "you") and PT Mahadata Teknologi Solusi ("Mahadata", "we", "us").

2. Description of Service

Mahadata provides a Communication Platform as a Service (CPaaS) that enables you to send and receive messages through various communication channels, primarily the WhatsApp Business Platform. The Services include access to our Mission Control portal, APIs for integration, and associated features for managing communications, campaigns, and contacts.

3. User Accounts and Responsibilities

To use the Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Client Obligations and Acceptable Use

You are solely responsible for all content, data, and information transmitted through the Services ("Client Content"). You agree to comply with all applicable laws and regulations in connection with your use of the Services, including but not limited to:

5. Fees and Payment

You agree to pay all applicable fees for the Services as described on our pricing page or in a separate agreement with us. Fees may include platform subscription fees, per-conversation charges from Meta, and other service charges. All fees are non-refundable. You are responsible for all taxes associated with your use of the Services.

6. Intellectual Property

We own all right, title, and interest in and to the Services, including all related intellectual property rights. These Terms do not grant you any rights to our trademarks or other brand features. You own all rights to your Client Content.

7. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. You may also terminate your account at any time. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. MAHADATA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAHADATA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law principles.
